Information on data protection and the processing of your personal data as part of the application process

At LEWA GmbH, we take data protection very seriously and endeavor to protect your data in the best possible way. We are therefore happy to inform you about the way in which your personal data is processed in our company and about the rights to which you are entitled under data protection law.

What categories of data do we use and where do they come from?

We process the following categories of personal data in particular

  • Your master data (first name, surname, name affixes and nationality),
  • Your contact details (private address, (mobile) telephone number, e-mail address),
  • Your application data (CV, certificates),
  • any presentation costs you may incur,
  • and, if applicable, log data from our IT systems in the case of an application received electronically.

As a rule, your personal data is collected directly from you as part of the application process. In addition, we may have received data from third parties (e.g. a recruitment agency).

For what purposes is your data processed?

Your personal data transmitted during the application process will be processed by us for the following purposes:

  • Processing of your application,
  • Decision-making for the establishment of an employment relationship,
  • Contact us using the contact details you have provided,
  • Forwarding of your application data within LEWA-GmbH for internal purposes (e.g. specialist department, works council, finance department for reimbursement of interview costs) or also to companies of the Atlas Copco Group (national/worldwide), if you so wish
  • longer-term storage of your application data, even after the advertised vacancy has been filled, provided you have consented to this.

On what legal basis is data processed?

We process your personal data in compliance with the provisions of the EU General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and all other relevant laws (e.g. BetrVG, ArbZG, etc.).

The lawfulness (legal basis) for the processing of your data results from your consent to the long-term storage of your application data or its transfer within the company group (pursuant to Art. 6 para. 1 lit. a GDPR), from the implementation of pre-contractual measures or for the establishment of an employment relationship (pursuant to Art. 6 para. 1 lit. b GDPR in conjunction with Section 26 para. 1 BDSG), the fulfillment of a legal obligation (pursuant to Art. 6 para. 1 lit. c GDPR) or to safeguard the legitimate interests of LEWA GmbH or third parties, e.g. for internal communication, defense against claims, investigation of criminal offenses or other administrative purposes (pursuant to Art. 6 para. 1 lit. f GDPR).

If we wish to process your personal data for a purpose not mentioned above, we will inform you in advance.

Who receives your data?

During the application process, you will be redirected from the LEWA career website to the Atlas Copco application portal (by clicking on “Apply now”). Further information on the processing of your data on this portal can be found in the data protection information provided there (under the link “Legal information and data protection information”).

The data you provide us with, such as your name, address, e-mail address, CV, reference documents, any documents from recruitment tests, etc., will be processed by us within the Atlas Copco Group as described here and at https://www.atlascopcogroup.com/de-de/privacy-policy/privacy-notice.

If you have consented to this, your data will be passed on regionally/worldwide within the Atlas Copco Group in accordance with your selection.

If necessary, your personal data will only be passed on to other third parties with your consent, unless there is a legal obligation to do so or to protect the rights, property and security of LEWA GmbH. Data will only be transferred to a third country at your request.

Insofar as external service providers come into contact with personal data, we require mandatory legal, technical and organizational measures to comply with data protection regulations.

How long will your data be stored?

We will only store your data for as long as is necessary to process your application. If your application is unsuccessful, this data will then be deleted after a waiting period of 6 months, provided you do not wish it to be stored for longer or there are no other legal obligations to continue storing the data. The legal basis for this is our legitimate interest in a burden of proof in proceedings under the General Equal Treatment Act (AGG).

If your application is successful, your personal data will be stored for as long as we are legally obliged to do so. This regularly results from legal obligations to provide evidence and retain data, which are regulated in the German Commercial Code and the German Fiscal Code, among others. The storage periods are up to ten years. In addition, personal data may be stored for the period during which claims can be asserted against us (statutory limitation period of three or up to thirty years).

If you have consented to the long-term storage of your application data as part of the application process, we will store this data until you revoke your consent or we delete your stored data on our own initiative.

What data protection rights can you assert as a data subject?

You have the right to information about your personal data stored by us at any time. We will also correct your data at your request if errors are found in the storage. At your request, we will of course also delete all your personal data, provided that we are not required to comply with any statutory retention obligations. In such cases, we will restrict your data for further processing so that it can no longer be used. You also have the right to receive the data you have provided in a structured, commonly used and machine-readable format. Furthermore, you have the right to withdraw your consent at any time.

Right to object on a case-by-case basis:

If we process your data to protect legitimate interests, you can object to this processing on grounds relating to your particular situation. We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or the processing serves the establishment, exercise or defense of legal claims.

Where can you complain?

If you are of the opinion that your data is not being processed by LEWA GmbH in accordance with the applicable data protection laws, you have the right to lodge a complaint with the data protection officer named above or with a supervisory authority for data protection.

Are you obliged to provide your data?

The provision of your data is necessary for the processing of your application and is voluntary on your part. However, we cannot process your application without this provision. If you withdraw your consent, your personal data will not be processed any further.

To what extent do automated individual case decisions or profiling measures take place?

Your data will not be used by us for automated decision-making or profiling.
